By law, a product must conform to the contract (“conformity”). This means that the product must correspond to the description, the expectations you could reasonably have based on the offer, and must be suitable for normal use. The statutory warranty applies for at least 2 years after delivery, as per Directive (EU) 2019/771. The exact duration depends on the type of product and the price – you may expect a product to last as reasonably expected.
In accordance with Directive (EU) 2019/771 (Article 11 paragraph 1), if a defect manifests itself within 1 year after delivery, it is presumed that the product is non-conforming, unless Superforlife proves otherwise. This protects you as a consumer in the event of defects occurring shortly after purchase.
In accordance with Directive (EU) 2019/771, regarding a non-conforming product, you are entitled to the following remedies, in this order:
In the first instance, you are entitled to free repair or replacement of the product, at your choice, unless either is impossible or disproportionately expensive compared to the other option.
If repair or replacement is not possible or successful, you are entitled to a proportional price reduction.
In the event of serious defects or when repair/replacement cannot be achieved within a reasonable timeframe and without serious inconvenience, you are entitled to a full refund. Repair or replacement will take place within a reasonable timeframe and without serious inconvenience to you. The costs of repair or replacement (including shipping, labor, and material costs) will be borne by Superforlife.
In addition to the statutory warranty, a product may have an additional manufacturer’s warranty from the manufacturer. This warranty is separate from the statutory warranty and does not limit your statutory rights. The terms of the manufacturer’s warranty are stated with the relevant product or in the accompanying documentation.
Your warranty rights are separate from your right of withdrawal. The right of withdrawal (30-day cooling-off period) applies regardless of whether the product is defective. The warranty applies to defects that occur after the cooling-off period or that you discover later.
